We offer bespoke mental capacity assessments as per requirement of our clients.
These may be tailored to:
- Testamentary capacity - capacity to make a will
- Power of attorney - capacity to decide power of attorney - for health and /or finances
- Court of Protection - to decide on deputyship. This may require CoP 3 form.
Capacity assessments
- capacity assessments are time and task specific
- first we assess if there is an impairment in functioning of brain or mind
- then we assess whether:
- one can understand the information given
- retain the information for a relevant period of time
- weigh the pros and cons of the information given
- communicate their decision.
Following our assessment, we will send you a detailed capacity assessment report.
Commissioning of report
We are approached by both solicitors or individual family member asking for a capacity assessment.
