Mental Capacity Assessment

We offer bespoke mental capacity assessments as per requirement of our clients.


These may be tailored to:

  • Testamentary capacity - capacity to make a will
  • Power of attorney - capacity to decide power of attorney - for health and /or finances
  • Court of Protection - to decide on deputyship. This may require CoP 3 form.


Capacity assessments

  • capacity assessments are time and task specific
  • first we assess if there is an impairment in functioning of brain or mind


  • then we assess whether:

  1. one can understand the information given
  2. retain the information for a relevant period of time
  3. weigh the pros and cons of the information given
  4. communicate their decision.

Following our assessment, we will send you a detailed capacity assessment report.


Commissioning of report

We are approached by both solicitors or individual family member asking for a capacity assessment.
